Rose Quarter Privacy Policy
Rip City Management LLC (“we”, “our” or “us”) respects your privacy and values your trust and confidence. This Privacy Policy (“Policy”) describes the information provided to us by you through any means, what we do with it, and the safeguards we have in place to protect it. The Policy applies to all users of RoseQuarter.com, our mobile applications, our services and transactions available via telephone, and any transaction that may take place in person, by postal or electronic mail (collectively, the “RQ Website”). Please note that this Policy applies only to information collected through the RQ Website and it does not apply to any information collected or obtained by any third-party entity, such as ticketmaster.com or Trail Blazers Inc., or through other means.
Before you submit any information to the RQ Website, please read this Policy for an explanation of how we will treat your personally identifiable information (“Personal ID”). Your use of any part of the RQ Website indicates your acceptance of this Policy and consent for the collection, processing, use and maintenance of your Personal ID in the United States, and where applicable, other countries, as outlined in this Policy. If you do not agree with this Policy, please do not use the RQ Website.
The Information We Collect. On the RQ Website, you may from time to time be able to order products, enter contests, vote in polls, express an opinion, or subscribe to one or more of our services, such as our online newsletters. The types of Personal ID that may be collected from information you provide may include your name, address, e-mail address, telephone number, fax number, credit card information, and information about your interests in and use of various products, programs and services.
We may also collect certain non-personally identifiable information when you visit one or more of our web pages, such as the type of browser you are using (e.g., Internet Explorer or Google Chrome), the type of operating system you are using (e.g., Microsoft Windows or Mac OS) and the domain name of your Internet Service Provider (e.g., Xfinity or CenturyLink).
How We Use the Information. We may use the information you provide to respond to specific inquiries made by you (e.g., in response to job applications or e-mailed questions); to prevent potentially prohibited or illegal activities, enforce the legal terms (including without limitation our policies and terms of service) that govern your use of the RQ Website, and/or for the purposes for which you provided the information; to customize, measure, analyze and improve our services, content and layout; or to customize or personalize ads, offers and content made available to you based on your visits to and/or usage of the RQ Website or other online or mobile websites, applications, platforms or services, and analyze the performance of those ads, offers and content, as well as your interaction with them. At times we may use the non-personally identifiable information that we collect to improve the design and content of the RQ Website and to enable us to personalize your Internet experience. We may also use this information in the aggregate to analyze site usage, as well as to offer you products, programs or services.
We maintain several e-mail lists to keep interested persons informed about events and other items of interest. Individuals can sign up to join our mailing lists in several ways, for example, in response to an e‑mail message or by using a form on the RQ Website. We do not sell, trade, lease, rent, loan or otherwise disclose the addresses on our mailing lists to any third party, except, possibly, a tenant of the Rose Quarter or a co-sponsor of a contest or sweepstakes who is denoted as such on the sign-in/information form.
We or a partner or third-party may use “cookies” or similar technologies to associate certain information with a unique identifier that then associates the information with your device or browser. For information about how these technologies work and how we may use them, please see below under Section 3‑Collection of Information by Third-Party Sites and/or Sponsors. In addition, we may use your information and/or supplement your information with information we obtain from other sources (e.g., partners, third-party providers, public sources) to customize and enhance your online experience, including for online advertising purposes as described below, and to notify you about special offers, products, services, and information that we think may be of interest to you. You can opt-out of receiving commercial e-mail from us at any time by indicating your preference according to the instructions provided within the e-mails received.
Collection of Information by Third-Party Sites and/or Sponsors. The RQ Website may contain links to other sites whose information practices may be different than ours. Visitors should consult the other sites’ privacy notices, as we have no control over information that is submitted to, or collected by, these third‑parties.
The RQ Website at times may offer contests, sweepstakes or promotions that are sponsored by or co‑sponsored with identified third parties. By virtue of their sponsorship, these third parties may obtain Personal ID that you may voluntarily provide for submission or participation in any contest, sweepstakes or promotion. We have no control over the third-party sponsors’ use of the information you may provide for any such submission or participation in such events. The RQ Website will notify you at the time of submission of Personal ID if a third-party sponsor will be obtaining such information.
Updating, Correcting or Deleting Personally Identifiable Information. For instructions on how you can access the Personal ID that the RQ Website has collected from you online, or to correct factual errors in such information, you may send an e-mail to: feedback@RoseQuarter.com. To protect your privacy and security, we will take reasonable steps to help verify your identity prior to granting access or making corrections to your information.
Cookies are pieces of electronic information that a website can transfer to a visitor’s hard drive to help tailor and keep records of his/her visit to such site. Cookies allow website operators to provide better customization for their visitor’s individual preferences. The use of cookies is standard on the Internet and most major websites use them. Although most web browsers automatically accept cookies, you can usually change your browser to prevent or notify you whenever you are sent a cookie. This gives you the chance to decide whether or not to accept it. Even without accepting a cookie, you can still access most of the features on the RQ Website.
Opting-Out. After gathering any user information, we offer users the opportunity to remove their information from our active database so as not to receive future communications and/or to no longer interact with the RQ Website until they choose to visit the “members” section of the site and amend the instructions they have previously provided. We also provide users the opportunity to update and modify any information they have previously provided by visiting the “members” section and updating and/or modifying their information (as provided in Section 4 above).
We have put in place appropriate physical, electronic and managerial procedures to safeguard and help prevent unauthorized access, maintain data security and for proper use of the information we collect online from our visitors. It is important to remember that whatever you transmit or disclose online can be collected and used by others or unlawfully intercepted by third parties. No data transmission over the Internet can be guaranteed to be 100% secure. Although we take appropriate measures to safeguard against unauthorized disclosures of information, we cannot guarantee you that Personal ID that we collect will never be disclosed in a manner that is inconsistent with this Policy.
Your site membership account is password protected. We recommend that you do not divulge your password to anyone. At no time will we ask for your password via email. If you ever receive such an inquiry, please notify us immediately at feedback@RoseQuarter.com. Ultimately, you are solely responsible for maintaining the secrecy of your member names, passwords and/or other account information.
Children’s Privacy Policy. Any child under the age of 13 (a “Child” or “Children”) may not be fully capable of understanding the consequences of giving out Personal ID online, therefore, the RQ Website does not knowingly solicit, obtain, retain or use information from anyone who indicates that they are a Child. Accordingly, Children may be restricted from participating in certain activities and transactions on the RQ Website. We will not entice a Child with the prospect of a special game, prize or other activity, to divulge information than is necessary or required to participate in any such activity.
We will not knowingly collect online contact information from a Child without prior consent from a parent/legal guardian or such parent/legal guardian directly providing such information, which may include an opportunity for the parent/legal guardian to prevent use of such information and/or participation in any activity. We will not give the ability to any Child to publicly post or otherwise distribute individually identifiable contact information without such Child’s prior parent/legal guardian consent. Any area on our site directed toward the entertainment of children will make every effort to prohibit a Child from posting any contact information. We will not distribute individually identifiable information collected from any Child to a third party.
If a parent/legal guardian believes that his or her Child may have provided us with Personal ID, for example, by misrepresenting his/her age, that parent/legal guardian should contact us at feedback@RoseQuarter.com with the particulars of the information we are alleged to have collected. If it is determined that such Child is under thirteen (13) years of age and has provided Personal ID we will immediately delete all such information. Governing Law. If any disputes arise between us regarding your use of the RQ Website, such disputes shall be resolved according to the laws of the State of Oregon, without regard to its choice-of-law provisions and the federal and state courts of Oregon shall have exclusive jurisdiction over all claims.
California Law permits our customers who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an e-mail to feedback@RoseQuarter.com.
Limitation of Liability. Neither Rip City Management LLC nor its agents or affiliates (collectively, “RCM”) will under any circumstances be liable to you for any consequential, incidental or special damages (including but not limited to lost profits) arising out of your use in any manner of the RQ Website, even if apprised of the likelihood of such damages occurring. Notwithstanding the foregoing, RCM’s liability is limited to the actual cost of any product or service purchased by you through the RQ Website.
Your Acceptance of These Terms. By using the RQ Website you consent to the collection and use by us of the information you provide. If we make any material changes to this Policy, those changes will be posted here so that you are always aware of what personal information is collected, how that information is used, and under what circumstances that information may be disclosed. Since this Policy may change from time to time, you should review it periodically and specifically before you provide any additional Personal ID. Your continued use of the RQ Website following the posting of changes to this Policy will signal your acceptance of such changes.

If you have any comments or questions about the information you or your children have submitted on the RQ Website, including its accuracy, integrity, or completeness, or if you need to access, review, verify, correct, amend, or remove such information, or if you have any questions or comments about our use of your children’s personal information or about our commitment to protecting you and your children’s privacy, you may send an email to feedback@RoseQuarter.com. We pledge to investigate any complaint you may have regarding our use of personal information and to comply fully with all legal or regulatory supervisory authorities responsible for enforcing our adherence to privacy principles stated above.
